User Agreement

The Terms and Conditions (T&CsS) contained herein along with the Privacy Policy and Terms of Use, collectively form an Agreement regulating our relationship with regard to the use of Teknoshack by you. Please read this Agreement carefully.

You are advised to regularly check for any amendments or updates to the terms and conditions from time to time. Unless stated otherwise, our current Privacy Policy and T&Cs applies to all information that we have about you and your account. 

Any clause of terms and conditions if deemed invalid, void or for any reason unenforceable, shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the terms and conditions.

Definitions

“Agreement” means the Terms and Conditions (T&Cs) contained herein along with the Privacy Policy and Terms of Use including other T&C at other portals of EFL under the Teknoshack brand name. It will also include references to this Agreement as and when amended, novated, supplemented, varied or replaced.

“Site” means the Teknoshack website owned and operated by Teknoshack, which provides a venue to the users to buy the products listed / displayed.

“User” means and includes any Customer / Buyer / You (the person or any legal entity) who accepts the offer for sale of the seller, through Teknoshack by placing an order on the site.

“Product/s” connotes the goods, services promoted / displayed on the site and offered for any use / sale. Teknoshack reserves the right to accept or reject your offer. Products/services and information displayed on Teknoshack site constitute an “Invitation to Offer”. Your order for purchase constitutes your “offer” which shall be subject to the terms and conditions as listed below. The agreement between you and the Teknoshack shall be subject to the following terms and conditions:

The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian as Use of Teknoshack website is available only to persons who can form a legally binding contract.

These terms and conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted. By using the services of Teknoshack website you agree to be bound by the Terms and Conditions. All prices, unless indicated otherwise are in United Arab Emirates Dirham.

All prices and availability of products are subject to change without prior notice at the sole discretion of Teknoshack.

Teknoshack reserves the right to refuse or cancel any order placed for a product without assigning any reason.

As a continuing policy of product improvement at Teknoshack, the design and specifications are subject to change without prior notice

On receipt of your request for the product, Teknoshack shall arrange to dispatch the product within the stipulated period.

In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost incurred by Teknoshack for redelivery shall be claimed from the User placing the order.

Teknoshack shall not be held liable for any delayed delivery of purchased goods due to, flood, fire, wars, acts of God or any cause of force majeure that is beyond the control of Teknoshack

The User expressly agrees that the use of services on Teknoshack site is at the User’s sole risk. The Services of Teknoshack is provided on an “as is” basis without warranties of any kind, whether express or implied. Teknoshack its affiliates, employees, agents, consultants, contracted companies make no warranties of any kind, whether expressed or implied, for the service it is providing or as to the results that may be obtained from use of the Service or as to the accuracy, reliability or content of any information, service or merchandise provided through this service.  You acknowledge and undertake that you are accessing the services on the website and transacting at your own risk and are using your best and prudent judgment before entering into any transactions through the website. You further acknowledge and undertake that you will use the website to order products only for your personal use and not for business purposes.

In no event shall Teknoshack, its directors, officials, representatives and employees be liable for any damages relating to products sold through its various platforms

Presently, for the time being the services of Teknoshack website are being offered for free. However, Teknoshack reserves the right to charge a fee to be decided by Teknoshack for any or all of its facilities

The User agrees to use the services provided by Teknoshack, its affiliates, consultants and contracted companies, for lawful purposes only

The User agrees to provide authentic and true information. Teknoshack reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), Teknoshack has the right in its sole discretion to reject the registration and debar the User from using the Services of Teknoshack website and / or other affiliated websites without prior intimation whatsoever

Teknoshack will not be responsible for any damage suffered by users from use of the services on this site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries or service interruptions as may occur. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of or use of record, whether for breach of contract, tortuous behaviour, negligence or under any other cause of action

Users who choose to access and/or use the site from other geographies and locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable

The user expressly agrees that the use of services of Teknoshack PRO is at the user’s sole risk. The services of Teknoshack PRO is provided on an “as is” basis without warranties of any kind, whether express or implied. Teknoshack its affiliates, employees, agents, consultants, contracted companies make no warranties of any kind, whether expressed or implied, for the service it is providing or as to the results that may be obtained from use of the service or as to the accuracy, reliability or content of any information, service or merchandise provided through this service.; Teknoshack shall in its best endeavour use reasonable efforts to maintain confidentiality of your information. it is also clearly understood that all warranties, implied or express take place between Teknoshack Limited and the user.

The User shall defend and fully indemnify Teknoshack and its officers, directors, employees and agents from and against any damages, claims, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by or on the User’s behalf or by third parties as a result of the User’s access and/or use of the site.

This site is designed and created exclusively by Teknoshack. Unauthorized use is strictly prohibited. All titles, trademarks, trade names, brands, logos, ownership rights and intellectual property rights, including copyright, rest with Teknoshack. The User shall not at any time and/or by any means copy, reproduce, distribute, sell, transfer, republish, store, archive or use other than as intended at this site with or without alteration or modification, any of the works, designs, contents, trademarks, trade names, brands and logos without the prior written permission of Teknoshack.

This agreement shall be construed in accordance with the applicable laws of India. The Courts at UAE shall have exclusive jurisdiction in any disputes arising out or pertaining.

The decision of Teknoshack in respect of any other terms and conditions outside the purview of the above shall be final and binding

You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way .You understand that you, and not Teknoshack, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.

Users of this website may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." In the event a user uses a false e-mail address, impersonates any person or entity, or otherwise misleads as to the origin of any content. Teknoshack reserves the right (but not the obligation) to remove, refuse, delete or edit any content that in the sole judgement of Teknoshack violates these conditions of use and, or terminate your permission to access or use this website

The Company reserves right to collect additional amount to recover the cost that the Company may incur to comply with the laws/government guidelines due to Force Majeure Event and towards safety of customers and service personnel attending the service request subject to following:

• Such costs shall be temporary in nature and shall be collected against issuance of receipt.
• The additional amount will be charged to every customer whether the product is in warranty or out of warranty or under AMC;
• The additional amount is not included in any other maintenance contract of any nature whatsoever;
• The additional amount shall be payable for every service call. No additional cost will be collected for subsequent visit by technicians within 30 days of attending service call;
• The additional cost shall not be collected from customers who shall carry the product to the authorized service center of the Company for service or repairs. However, the cost of consumables and spare parts shall be levied as per the terms and conditions of AMC/warranty of the products.
